Legal documents obtained by the Peoples Gazette reveal that Mr. Tinubu's legal representatives in the United States have taken proactive steps by submitting motions to participate in an ongoing Freedom of Information Act (FOIA) proceeding against these U.S. entities, where records that could shed light on the president's true identity and extensive pursuits spanning decades are housed.

Christopher Carmichael, one of the attorneys who previously represented Mr. Tinubu in a notable Chicago records case, filed this motion on October 18, 2023. The document explicitly affirmed Mr. Carmichael's standing as a duly accredited and actively practicing attorney, thereby seeking admission to participate in the ongoing FOIA litigation based in Washington D.C.

Bryan A. Carey, a Washington D.C.-based attorney, articulated Mr. Carmichael's motion as follows: "In accordance with Civil Local Rule 83.2(c), Bryan A. Carey seeks the admission and appearance of attorney Christopher Carmichael pro hac vice in the aforementioned action." He went on to convey, "This motion is substantiated by the Declaration of Christopher Carmichael. As outlined in Mr. Carmichael’s declaration, he holds active membership in good standing."

The underlying basis for Mr. Tinubu's conviction that he can impede U.S. agencies from complying with federal disclosure regulations remains veiled in secrecy. Currently, Mr. Carmichael has refrained from providing immediate commentary, while Oluwole Afolabi, the lead attorney representing the president in the U.S., relayed to The Gazette that he is unable to comment on the case until its official initiation. The legal team is diligently preparing a thorough argument to be submitted at the earliest opportunity, with the aim of leveraging any potential legal recourse prior to the looming October 31 deadline.

Mr. Tinubu became aware of the lawsuit after The Gazette's report on September 11, revealing the FBI's plan to provide 2,500 pages of pertinent information about the Nigerian leader. Notably, the president was previously under investigation for narcotics trafficking in the U.S. during the 1990s, leading to a federal court order demanding the forfeiture of $460,000.
