US Judge Halts Chicago University Records Release to Atiku, Citing Tinubu's Life Concerns.

Judge Nancy Maldonado, presiding over the United States District Court for the Northern District of Illinois, has issued an immediate halt on the release of President Bola Tinubu's university records, following his plea of severe and irreversible consequences to his life.

Upon the request of Mr. Tinubu through his legal representatives, Judge Maldonado, recognizing the gravity of the situation, granted a stay on the September 6 order of Judge Jeffrey Gilbert, a magistrate. She emphasized the need for careful handling of the matter.

The judge has given Mr. Tinubu's lawyers until Monday to submit a comprehensive brief on the issue before the court. In response, Atiku Abubakar's legal team has committed to providing their reply by 11:00 p.m. on the same day.

Judge Maldonado remarked, "I may ultimately adopt the magistrate’s recommendation and allow the discovery to go forward, or I can ask all parties to file briefs afresh."

The focal point of contention is Mr. Abubakar's subpoena application to obtain records of Mr. Tinubu from Chicago State University, owing to significant discrepancies with the Nigerian president’s academic records already in the public domain.

Mr. Abubakar's application was granted in a judgment handed down by Mr. Gilbert on Tuesday, which mandated the production of the documents as well as the deposition of the school’s administrators. Mr. Abubakar intends to utilize these records to assert Mr. Tinubu’s ineligibility for the presidency, based on the constitutional clause disqualifying a candidate who submits a falsified certificate to the electoral office INEC.

Officials from CSU affirm Mr. Tinubu's attendance at the institution, yet they express uncertainty in attesting to the authenticity of his certificate under oath due to ambiguity surrounding its origin.

Initially, Mr. Tinubu argued against releasing the documents to Mr. Abubakar, contending that they would not hold in the Nigerian Supreme Court, where Abubakar plans to present them as part of his appeal against a tribunal verdict that validated Mr. Tinubu’s election on September 6.

On September 19, coinciding with Judge Gilbert's directive for CSU to furnish Mr. Tinubu's records within a two-day window, Mr. Abubakar promptly lodged his appeal with the Supreme Court. Yet, as the 48-hour limit loomed on Thursday afternoon, Mr. Tinubu urgently implored Ms. Maldonado for a postponement, heightening the gravity of the situation, citing the potential threat to his well-being.

Mr. Tinubu’s lawyer argued, "Severe and irreparable harm will be done to Bola Tinubu if the records are released," during an emergency appeal before Judge Nancy Maldonado of the United States District Court for the Northern District of Illinois in Chicago. He emphasized that once released, the harm cannot be undone. The court hearing, conducted via a telephone conference, lasted approximately 40 minutes.
